Preamble
These are the Terms and Conditions, for using the Paid Hosting Services provided by Liway Hosting.
From here on, these Terms and Conditions shall be referred to as "T&C" and Liway Hosting shall be referred to as "we", "us", "our" and "LH", and the end user, which uses the Free Hosting Services provided by Liway Hosting will be referred to as "you".
You agree to our Terms and Conditions by saying so at the time of the request for free hosting.
Our Terms and Conditions are subject to change at any time at all, without any notice. Although when major revisions occur, we may send out email notifications to inform you.
1. Liability
Once you acquire hosting from us, we will allocate resources for you to use. You and only you are responsible for what you do with your account and resources - not us. You are responsible for all use of these resources, and you agree to be accountable for their usage.
2. Illegal Activities
You're not allowed to carry out any illegal activities as stated by US and International Laws. Examples of illegal activities, are hosting or linking to any of the following;
- Warez
- Pirated Music
- Copyright Information (unless you are it's sole owner)
- Malware
- Parasites (ie, spyware, adware, trojans)
If you carry out illegal activities, there will be an immediate termination of your services.
In addition we have the right to disclose your information, if you are caught conducting any such activities, such as but not limited to;
- Name
- Email Address
- IP Address
- Usage History
This information and other if required will be disclosed to parties taking up action against you, should you carry out illegal activities.
3. Unacceptable Use Policy [ UAUP ]
You must abide by our Unacceptable Use Policy. Failure to do so, will result in an immediate termination of your account.
4. Server Resource Use
You are not allowed use more than 25% of available RAM or more than 25% of available CPU power (0.25 CPU units per core). This goes for those accounts which exist under your reseller account.
You must not run scripts which take a lot of processing power or RAM. You must not carry our actions which will result in excessive use of the server's resources.
If your website/forum uses a lot of server resources, we suggest you look into getting dedicated hosting.
5. Warranties and Guarantees
None exists.
We do not have any guarantees or warranties to give you. But by all means don't let that lose your faith in us.
Our servers are in a secure datacenter, with backup generators, UPS, DDOS attack protection and what have you. We have significant experience when it comes to server security, and every little tweak which is possible, is implemented. We use additional security software most webhosts don't even know about.
We have been in business for about three years now, and our ongoing update over the last year is around 99%. However to guarantee an uptime is very ridiculous by our opinion, as there are a million things which could happen - which are totally out of our reach - which would spoil the uptime, therefore we choose to not make false guarantees, with hope that nothing will ever go wrong.
However our promise is our record, and we strive to provide the best uptime and services to you.
6. SPAM
You are absolutely forbidden to use our servers to send SPAM or any other commercial email or any unsolicited email whatsoever, unless your customers specifically signed up for it!
It is a requirement by law to include an "unsubscribe" link at the footer of any mailing list emails you send.
Failure to comply with this will have your account immediately terminated, and legal action taken towards you. In addition, you will be blacklisted on no less than seven different blacklists, including RBL, which will make sure you will never get hosting anywhere again.
Please note, that this rule applies to those accounts which exist under your reseller account.
7. Account Holder Information
If you are registered on the Liway Forums, then you must be either at or over 13 years of age or have parental permission to be there.
All information you give to us when requesting your hosting must be true, valid and accurate.
8. Account Upkeep
If you fail to pay for your hosting service within 7 days of being issued an invoice, you will be warned. If you fail to pay for a month, we will suspend and terminate your account. We will contact you by your email address as it's set at the member's portal] about such matters.
9. Account Checking & Privacy
We reserve the right to access your hosting account and those accounts which exist under your reseller account at any time. This includes, but is not limited to, disk space (including emails), SQL databases and cPanel information.
This is done in order to check that you are not violating either the T&C or the UAUP. Please do not be concerned with your privacy, Liway Hosting will not disclose any information found on our hosting account, as long as it is legal. On a regular basis your space will be checked for suspicious files, nothing more.
In addition we at any time may request to be given access to any section of your hosting account (such as a website), blocked by a server side script or any means at all, to check against any wrong doings.
Please note, that this rule applies to those accounts which exist under your reseller account.
10. Backups
We do not provide any service where we take regular or any backups of your hosting account. We create regular backups of our entire server, however we are not able to extract individual accounts from that. Only you are responsible for making, keeping and using if necessary, backups of your hosting account. We encourage the use of the cPanel backup feature for this task.
11. Cancellation Of Service
You may cancel your use of our services at any time.
You can do this by lodging a support ticket at the support portal.
12. Termination Of Service
Likewise, we may terminate your account at any given time, without any notice.
In these scenarios, you cannot hold us accountable, and you cannot take any action towards or against us. It is our right as your hosting provider to terminate your hosting if we want to.
Hosting may be terminated if you break the T&C or the UAUP. Depending on the severity of the violation and our certainty that your are responsible, we may suspend your account and send you a warning, requesting for you to explain yourself.
13. Reselling and Sharing of our Service
Under the reseller terms and conditions, you are allowed to resell the resources we provide you with, to any extent you wish. If you go over your allowed actual resource use, your accounts and all those accounts which exist under your reseller account will be suspended.
You and all your customers are constrained by your reseller resource usage limits, which apply collectively to your account and all those accounts which exist under your reseller account.
14. Proxies
We have a fine line about proxies - no proxies...none at all. If someone is found running a proxy, their account is suspended right away without warning. It doesn't matter whether the proxy is written in Perl, PHP or any other script. It doesn't matter if it's open/public or private. They are simply forbidden.
